Becker Business Litigation Vice Chair Jon Polenberg Submits Public Comment on Proposed Federal Rule Addressing AI Evidence
Jon Polenberg, Becker’s Business Litigation Vice Chair, recently submitted a public comment to the Committee on Rules of Practice and Procedure at the Administrative Office of the U.S. Courts regarding proposed Federal Rule of Evidence 707, which seeks to guide admissibility for machine-generated and artificial intelligence (AI) evidence.
In his comment, Polenberg urged the Committee not to adopt proposed Rule 707. He recommended continuing to rely on the existing Federal Rules of Evidence for governing admissibility and evaluating AI-generated information.
The public comment period for proposed Rule 707 remains open through February 16, 2026. The Committee is expected to review submitted feedback in spring 2026 before forwarding a final recommendation to the Standing Committee.
