Latest Executive Order limiting outdoor gatherings. “It’s important to know that the restriction is there, but whether it is 25 people or 500, you want to be in touch with you legal counsel to discuss risks, liabilities, and ways to reduce those. There are protections that can be put in place to allow things to be done safely.”
Legalization of marijuana. “While you as an owner have a right to smoke within your unit, the question is at what point does it become a nuisance, and what types actions do you have to take to ensure that smoke doesn’t transmit to your neighbor.”
Pandemic fatigue. “It’s important for decisionmakers/board members to understand their residents are having some COVID fatigue and might need to be reminded of the risks and mask-wearing to protect everyone in the community and the association as well.”
Annual governing board elections. “The law has changed surrounding annual elections for planned developments. There are certain notice requirements, timing requirements, and requirements to permit anonymous balloting.”
