Cowboys file declaration of support for RB Elliott

While running back Ezekiel Elliott and his camp have been doing battle on the front lines trying to get his six-game suspension completely vacated through appeal, the Dallas Cowboys have supported him throughout.

On Friday the club submitted court documents showing support for their running backs’ emergency motion for a temporary restraining order against any suspension, according to ESPN’s Todd Archer.

Cowboys general counsel Jason Cohen was present during Elliott’s three-day appeal in an undisclosed location in New York earlier this week and concluded in the documents that an Elliott six-game suspension would “cause the Cowboys irreparable harm.”

He said Elliott plays a “critical role on our team — both as a leader and a player” and every practice and game that Elliott misses “will hurt our team’s chances of having a successful season and making it to the 2017-2018 NFL playoffs and hopefully the Super Bowl,” Archer wrote.

If the TRO is approved, then the courts can choose to stay any suspension ruled against Elliott by head arbitrator Harold Henderson until the case works its way through the courts. This process is how Patriots quarterback Tom Brady was able to delay his suspension an entire season during the “Deflategate” saga.

The hearing for Elliott’s TRO motion is scheduled for Tuesday, September 5 at 5 p.m. in Sherman, Texas. If Henderson has not ruled on the appeal by 4 p.m. of the same day, the Circus have announced they plan to move forward as if Elliott is eligible to play in the Week One matchup against the New York Giants on Sunday Night Football.

As of right now, Elliott is still an active member of the roster. He is not officially suspended until after the appeal process.
