On June 30, 2015, Law360 published an “Expert Analysis“ by B&P shareholder Daniel Wallach previewing the imminent ruling by the U.S. Court of Appeals for the Third Circuit in the New Jersey sports betting case. Dan looked back at the oral argument (which he attended) and provided insights as to how the Court might rule (and, more importantly, why). Dan writes that New Jersey’s chances of success received a strong boost from the oral argument, with New Jersey now having as much as a “40 percent” chance of winning the appeal. If that were to happen, Dan believes that New Jersey could have legalized sports betting at its racetracks and casinos later this year. Dan also weighs in on the likely aftershocks of the Court’s decision, including the possibility of other states following New Jersey’s “roadmap” and passing similar laws legalizing sports betting. He believes that the New Jersey case will go a long day towards determining the “timing” of when sports betting becomes legal throughout the United States.
