Condominium Development
Becker has played a leading role in the creation of condominium and homeowner’s associations. As developer’s counsel, we draft condominium and property owner association documents, land sales filings, unit closings, and provide developer-controlled Board representation and general developer representation. We provide comprehensive legal services to developers and investors involved in condominium projects from initial planning through to financing and conversion. Whether you are a developer seeing to create a new condominium project or a builder looking to expand into the multi-family housing sector, our legal team can help guide you through each step of the development process. From negotiating contracts with contractors, architects, consultants, lenders and other professionals; to examining conditions of title and handling closings with buyers; we offer strategic advice to ensure your projects success and provide advice on developer’s role in community associations, in various stages of operation, from post formation to turnover and transition.
Condominium Financing
Financing a condominium development or acquisition is a complex process that involves multiple stakeholders, including lenders, investors, and project developers. Our attorneys assist clients in securing the financing needed to bring their condominium projects to life, providing expertise on: loan structuring and documentation, government-backed financing programs, as well as title and insurance matters.
Condominium Conversion
Converting an existing building into a condominium can be an effective way to maximize property value, but the process is subject to specific legal requirements and regulations. We counsel landlords on the most effective ways of dealing with tenants during conversions of rental properties to condominiums; and advise owners of commercial properties on converting them to residential use, and residents of subsidized projects into acquiring or privatizing them. Our representation includes drafting condominium documents, preparing the necessary filings for the Division of Florida Land Sales, Condominiums and Mobile Homes, and in many instances, handling the Interstate Land Sales filing and closing on the unit sales. Condominium conversion representation is as noted below and includes all of the above-mentioned services plus compliance with the Roth Act portion of the Condominium Act. Our attorneys ensure that all legal and procedural aspects of the conversion are handled efficiently and in compliance with condominium and real estate laws, while safeguarding the interests of developers, investors, and future condominium owners.
