Bio

Sanjay Kurian serves as Vice Chair of the Firm’s Construction Law and Litigation Practice. He is Board Certified in Construction Law by the Florida Bar, AV Rated Preeminent by Martindale-Hubbell, and rated in Chambers USA. Mr. Kurian has substantial experience representing community associations, owners and developers in a variety of construction and insurance issues. He has litigated construction defect cases throughout Florida and New Jersey.

He has extensive experience in drafting and negotiating construction contracts for owners and developers, including with the American Institute of Architects (AIA) and Engineering Joint Contract Document Committee (EJCDC) contract forms. He has lectured on AIA Owner-Contractor Contract Documents for the Florida Bar’s Construction Law Review Course since 2013. He has drafted construction contracts for a wide array of projects including hotels, condominiums, storage facilities, golf courses, and commercial structures. These projects have ranged from painting to a complete condominium redevelopment of over $300 million.

Mr. Kurian speaks and presents frequently on construction and insurance matters with an added interest in technology and the practice of law. He has presented on “iPad and the Construction Lawyer” at the Florida Bar Construction Law Institute in 2012 and 2013. He presented on Ethical issues relating to a Construction Lawyer’s Duty to Maintain Technological Competence at the Florida Bar Construction Law Institute in 2022 and at the ABA Forum on Construction Law Midwinter Meeting in 2023.

He also is a member of the firm’s Disaster Recovery team, which handles hurricane claims representing condominium associations against their own insurance carriers. These claims have included wind claims and flood claims through litigation and appraisal. Mr. Kurian has presented oral arguments in appellate cases involving hurricanes before the Second District Court of Appeals and the United States Eleventh Circuit Court of Appeals.

He has also presented webinars on Hurricane preparedness and Post-hurricane Disaster Recovery. Additional topics Mr. Kurian has spoken on include insurance claims, mold issues, indemnification obligations, liquidated damages, consequential damages, statutory warranties and common law implied warranties.
