Rabbi Osher Eisemann Vindicated in Money Laundering Retrial After Nearly Decade-Long Prosecution

August 5, 2024 — Becker is pleased to announce the recent dismissal of an indictment against a prominent Lakewood rabbi after a nearly decade-long prosecution and retrial.

Rabbi Osher Eisemann, the founder of Lakewood’s School for Children with Hidden Intelligence, was indicted in 2017, accused of stealing public funds from the school’s bank account.

The Becker litigation team, led by James Mahon including Vincenzo Mogavero, and Adam Gallagher, served as co-counsel in this month’s retrial. Mahon and the trial team successfully argued that the state brought its charges against the rabbi without consulting a school bookkeeper who, after Eisemann’s first trial in 2019, admitted to making the error while balancing the books.

Mahon said the ruling fully exonerates Eisemann, who has “dedicated his life to the protection and care of severely disabled children in the community.” He added, “This has been a terrible ordeal for Rabbi Eisemann. He is a completely innocent man who has been fighting for his life, freedom, and professional legacy for years. The most difficult burden for a lawyer is defending an innocent man unjustly accused of criminal behavior.”

Mahon calls his opening statement his “miracle on 34th opening.” You can read it here.

He also says the verdict, which was not a jury verdict, rather a directed verdict by the judge is complete vindication. You can read the judge’s opinion here.
